Freelancer and social insurance

Hello,

a question regarding the social insurance obligation of a freelancer.

My husband is a freelance trainer, coach, and consultant and employs 2 mini-job workers. The two workers together receive 450.15 (285+165.15) in wages and do not pay any contributions to the pension insurance. My husband has registered them with the mini-job center and pays the insurance contributions. Now the question is: Is my husband exempt from the pension insurance obligation with this constellation?

The German Pension Insurance says the following:

"If you employ an assistant within the marginal employment limit (up to 450.00 euros/month), you also remain subject to insurance. It is different if you have several marginally employed workers who replace an insurance-paying employee."

It is just not clear if these two marginally employed workers also have to be subject to insurance. Because at the moment, the two workers are not insured, as they do not pay into the pension insurance.
