Money from the mother from Romania
July 11, 2011 | 20,00 EUR | answered by StB Olaf Gayko
My mother lives in Romania and wants to gift me (living in Germany, a German citizen, married, one child) 150,000 € (transfer from Romania).
Is the gift taxable in Germany and what do I need to consider?
Dear questioner,
Dear questioner,
First of all, thank you for your inquiry, which I would be happy to answer based on the information you provided and in the context of an initial consultation.
The answer is based on the facts presented. Missing or incorrect information about the actual circumstances may affect the legal outcome.
The tax exemption (FB) for gift tax for a gift from a mother to her child is €400,000 / 10 years; § 16 I 2 ErbStG. Therefore, you do not have to worry about any tax complications.
The gift is tax-free as long as you have not received gifts in the past that exceeded the FB along with the money gift.
However, it is possible that the bank may report the gift as part of anti-money laundering efforts or that the tax office may inquire about the source of the money and any interest income.
I hope this information has been helpful to you.
Best regards from Wuppertal
