Ask a tax advisor on the topic of Corporate tax

Is the corporate tax different for my industry?

Dear tax advisor,

my name is Heike Otten and I work as the managing director of a small IT company. In recent years, our industry has experienced strong growth and we are now operating internationally. As we continue to grow and expand, I am now wondering if the corporation tax for my industry is different compared to other industries.

Currently, as a GmbH, we pay the regular corporation tax rate of 15%. However, I have heard that there may be special regulations or tax advantages for companies in the IT industry. Since we make many investments in research and development and regularly invest in new technologies, I am wondering if we could possibly benefit from tax relief.

I am concerned that due to lack of knowledge, we may be missing out on tax advantages or even disadvantaging ourselves by incorrectly calculating the corporation tax. Therefore, I would like to learn more about the tax specifics for companies in the IT industry and find out if there are opportunities for us to optimize our tax burden.

Could you please explain to me if the corporation tax for my industry is indeed different and what special regulations there may be? Are there tax advantages that we are not currently benefiting from? And if so, how can we take advantage of them?

Thank you in advance for your help and support.

Kind regards,

Heike Otten

Dear Mrs. Otten,

Thank you for your inquiry regarding corporate tax for companies in the IT industry. As the managing director of a small IT company, you are surely interested in optimizing your tax burden and taking advantage of possible tax benefits.

First of all, I would like to inform you that corporate tax for companies in the IT industry is generally not different from companies in other industries. The regular corporate tax rate in Germany is 15% for GmbHs and 25% for AGs. These tax rates apply regardless of the industry in which the company operates.

However, there are indeed special regulations and tax benefits that companies in the IT industry can benefit from. One of these tax benefits relates to the promotion of research and development. Companies that invest in innovative projects and develop new technologies may, under certain conditions, be eligible for tax relief.

For example, there is the possibility to claim research grants or tax research funding. These can help reduce the tax burden for your company. Additionally, there is also the option to deduct certain expenses for research and development as operating expenses for tax purposes.

To benefit from these tax advantages, it is important that you meet the necessary requirements and provide the necessary evidence. Therefore, it is recommended to consult with a tax advisor to assess the possibilities for optimizing your tax burden and take appropriate measures if necessary.

Overall, there are indeed opportunities for companies in the IT industry to optimize their tax burden and benefit from tax relief. I recommend contacting an expert in this field to analyze your individual situation and take suitable measures.

I hope this information has been helpful to you. If you have any further questions, please feel free to contact me.

Best regards,

Mia Köhler
