Offsetting of loss carryforward
October 30, 2012 | 30,00 EUR | answered by Dr. Yanqiong Bolik
Hello,
I have a carryforward loss of several thousand euros from "income from private sales transactions according to § 23 EStG in the version applicable until December 31, 2008". My tax office points out that these losses can be offset against capital gains on request until 2013. Currently, I only see gains from investments (bonds, funds, stocks) in my securities account. Is this assessment correct? Or could these losses also be offset against income from business operations or rental and leasing?
How can the offset with capital gains from capital assets be carried out: Only retrospectively in the context of tax returns for 2012 and 2013? Or can the carryforward loss be transferred to the custodian bank, which then automatically offsets it with every securities transaction?
Dear inquirer,
Thank you for your inquiry, which I am happy to answer taking into consideration your input and the rules of this platform.
Please note that my explanation is based on the facts presented, and that adding, omitting, changing information, or the ambiguity of the information can change the tax result.
Your assessment is correct: Offsetting with capital gains means that the carried forward loss can only be offset within the income from capital assets. Offsetting this loss with income from business operations or rental income is not possible.
The offsetting is done through the assessment of income tax by your tax office, not by your brokerage. You must report the capital gains from your capital assets and the determined loss carryforward amount in your tax return. The tax office should take the loss offset into account in the assessment.
I hope I was able to assist you.
