Is there a maximum limit for the amount of membership fees in a non-profit organization?

Dear Tax Advisor,
I am Lilli Nitsche and I am the director of a non-profit organization that is dedicated to the promotion of children and young people. In our organization, we mainly finance our projects through the membership fees of our members. Lately, we have been having discussions about whether there is a limit to the amount of membership fees in a non-profit organization.
Currently, our highest membership fee is 50€ per month, as we believe these amounts are appropriate and affordable for most of our members. However, there are some members who would like to pay higher fees to further support our projects.
My concern is that we may be violating non-profit guidelines if we set the membership fees too high. Is there a limit to the amount of membership fees in a non-profit organization? And if so, how can we ensure that we comply with these guidelines without alienating potential donors?
I would greatly appreciate your assessment and possible solutions. Thank you in advance for your help.
Sincerely,
Lilli Nitsche
Dear Mrs. Nitsche,
Thank you for your question regarding the limit for the amount of membership fees in a nonprofit organization. It is important to be aware of the tax regulations in the field of nonprofit work to avoid possible violations.
Generally, there is no set limit for the amount of membership fees in a nonprofit organization. However, the fees must be reasonable and should not be used to generate profits. The fees should be in a reasonable proportion to the services that the organization provides to its members.
It is possible that the tax office will review the amount of membership fees to ensure that they are not considered as hidden donations. In this case, there could be issues with the nonprofit status. Therefore, it is advisable to make the amount of membership fees transparent and document the services that members receive in return.
If some members would like to pay higher fees to support the projects of the organization more strongly, you can offer a donation option, for example. These donations can be made in addition to the regular membership fees and are tax deductible. This way, you can ensure that the membership fees remain reasonable and that donors still have the opportunity to provide additional financial support.
It is also important to regularly review and, if necessary, amend the organization's statutes to ensure compliance with all tax regulations. It is recommended to work closely with an experienced tax advisor to minimize potential risks.
I hope this information is helpful to you and I am available for further questions.
Best regards,
Günther Schmidt
