Declaration of assumption of repair costs
October 21, 2010 | 25,00 EUR | answered by Steffan Schwerin
Good evening,
A few weeks ago, someone rear-ended me. The other party's insurance will cover the damage. I signed a repair cost acceptance declaration at my car dealership, in which I assigned my repair cost claims to the dealership. However, I have not yet issued a repair order and the vehicle has not been repaired yet. Now I would like to have the car repaired at a different workshop. I also want to settle based on an appraisal.
Can I withdraw from the repair cost acceptance declaration and assign the repair to a different workshop?
Dear questioner,
I will answer the questions you have posed, taking into account the information provided and your efforts, as follows:
Yes, you can retract this statement. By signing this statement, you are not obligating the car dealership to repair your vehicle.
Rather, the purpose of this statement is for the car dealership to bill the costs directly to the opposing insurance company in the event of a repair order.
There are no further obligations arising from this statement.
Therefore, it is sufficient to inform the car dealership that you are no longer interested in collaborating and will have your vehicle repaired elsewhere.
You can then appoint another workshop.
I would like to point out that this platform cannot replace comprehensive and personal legal advice. The sole aim is to provide an initial rough assessment of your legal issue based on the information you have provided, from a lawyer.
The legal advice I provide is solely based on the information you have provided. By adding or omitting relevant information in your description, a completely different legal assessment may result.
I hope I have been able to give you a first overview and that my explanations have been helpful. Please feel free to contact me via the follow-up option on this portal.
Furthermore, I am available for further legal representation. The initial consultation fee would be fully credited.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, post, fax, and telephone, legal representation is also possible.
Yours sincerely,
