Reimbursement from a private insurance

Hello, I have a question: I haven't been receiving Hartz 4 benefits since May 09, and now it looks like I may receive a retroactive payment from a private pension insurance. This money would be coming to me almost a year after I stopped receiving Hartz 4. Am I allowed to keep this retroactive payment? I was told by the authorities that for private insurances, the principle of income counts. The retroactive payment is considered income for the month in which it is received. Since this money is coming to me months after I stopped receiving Hartz 4 benefits, am I allowed to keep it, as I also need to live off of it? Is this correct?
