Ask a lawyer on the topic of Patent law

What steps do I need to take to extend my patent?

Dear Patent Attorney,

I am Max Kaiser and a few years ago I filed a patent for an innovative technology that is intended to give me a competitive advantage. However, the patent is soon expiring and I am concerned that I may lose my investments and the work I have put into developing the technology.

I am now faced with the question of what steps I need to take to extend my patent and thus continue to secure the rights to my invention. I am aware that there are certain deadlines and requirements that must be met to apply for an extension.

Could you please explain to me what specific steps are required to extend my patent? What deadlines do I need to observe and what documents are needed to submit the extension application? Are there any associated costs and approximately how much are they?

Furthermore, I would like to know if there are alternative options to extend the protection of my invention if extending the patent is not possible. I am willing to take further steps to continue protecting my technology from unauthorized use by third parties.

I thank you in advance for your assistance and advice on this matter and look forward to your response.

Sincerely,
Max Kaiser

Andrea Maier

Dear Mr. Kaiser,

Thank you for your inquiry regarding the extension of your patent for your innovative technology. It is understandable that you are concerned about protecting your investments and work, especially as the patent is soon to expire. I am happy to explain to you the necessary steps to extend your patent and secure your rights to your invention.

First and foremost, it is important to know that the extension of a patent is generally possible, provided certain conditions are met. The exact steps and deadlines may vary depending on the country in which the patent is filed. In Germany, for example, an extension of the patent can be requested through an application to the German Patent and Trademark Office (DPMA). It is important to ensure that the application is submitted in a timely manner before the patent expires. You can inquire about the exact deadlines at the DPMA or consult the relevant laws.

For the extension application, certain documents are usually required, such as a justification for the extension, information about the invention, and possibly fees. The costs for extending a patent can also vary and depend on various factors, such as the duration of the extension and the country in which the patent is filed.

If an extension of the patent is not possible or if you are looking for alternative ways to extend the protection of your invention, there are various options available. One option could be to apply for a supplementary protection certificate, which can extend the protection of your invention for a certain period of time. Transferring licensing rights or filing additional patents to expand the scope of protection are also possible measures to protect your technology from unauthorized use.

I recommend you to consult with a specialized patent attorney to discuss your individual situation and determine the best options for extending the protection of your invention. I am available to answer any further questions and support you in securing your rights to your technology.

Best regards,
