Remaining property at girlfriend's
February 5, 2011 | 35,00 EUR | answered by Dr. Dr. Danjel-Philippe Newerla
Hello Mr. RA
I am currently having issues with my girlfriend and am left with some small things that are still at her place. Now, I am supposed to pick up the rest today at 3:00 pm, otherwise she would destroy my remaining belongings. Is she allowed to do that so easily, as there are still things in there that belong to the government. She has appointed a supervisor as a witness for the collection of my remaining belongings. If I go there alone, there is a risk of false accusations for or against which I do not have a witness myself. Should I involve the police or?? Do you have any advice for me???
Best regards
Dear Seeker,
Thank you for your inquiry. I would like to answer it as follows:
You are absolutely right. If your girlfriend destroys your belongings, she is committing a criminal offence of property damage and is liable to compensate you for the damages. She would have to reimburse you for the current value of the items.
The police are not responsible in this case.
I strongly advise you to bring a confidential witness (for example, a relative) with you to protect yourself against any potential false accusations.
I hope that I have provided you with some initial legal guidance and wish you every success and all the best!
I would like to point out the following to you:
The legal advice I have given is based solely on the information provided by you. My response is only a preliminary legal assessment of the situation and cannot replace a comprehensive examination of the facts. Adding or omitting relevant information can lead to a completely different legal assessment.
I hope that my explanations have been helpful to you. You are welcome to contact me via my email address or the follow-up option.
I wish you a pleasant Saturday afternoon and a relaxing weekend.
Kind regards from the North Sea coast,
