Dear Sir or Madam,
I have 2 questions:
In March 03, an acquaintance approached me about managing her mother's rental property. We reached an agreement. A contract was signed in the mother's name, but on behalf of the daughter. The mother gave me authorization to collect bank statements for the purpose of reviewing rental income. I had contact with both the daughter and the mother.
In the summer of 08, without explanation, the payments (made from the mother's account) were stopped and all documents in my possession were requested to be returned.
I wrote that I would be willing to return the documents after a proper termination of the contract and payment of outstanding fees. I heard nothing back.
In March, a lawyer's letter arrived with the same request and a precautionary termination for 31.03.09 (without adhering to the notice period). I did not respond. Now there is a lawsuit again demanding the return of documents and stating:
"It was a precautionary termination, as it can even be assumed that the contract was void from the beginning. The plaintiff has never approved the contract."
This is not true, as the plaintiff herself paid me.
I now want a) the money owed to me and b) to return the documents.
Additionally, it is stated:
The defendant is ordered to bear the legal costs and litigation.
If the court decides on written proceedings and the defendant acknowledges the claim in writing...an application is made for: acknowledgment or...
