Transfer house

Hello, my wife should inherit the house of her grandparents. The mother of my wife, who is the daughter of the grandparents, should not inherit the house and is also in agreement with this. How can we transfer the house to me and my wife in a cost-effective and secure way? The condition is that after the death of the grandparents, the house should not go to the mother or any mandatory share.

Dear questioner,

I will answer the questions you have asked, taking into account the circumstances described and your input, as follows:

For example, a gift can be made subject to a condition under § 525 of the German Civil Code (BGB). The condition could be that the daughter receives nothing.

Alternatively, the daughter could sign a waiver declaration. This would prevent her from making any claims to the house in the future.

Furthermore, the house does not necessarily have to be gifted. Instead, a right of residence or usufruct could be granted to you.
