Can I file for divorce online?

Dear lawyer,

my name is Dennis Koch and I am faced with the difficult decision of getting a divorce from my wife. After much consideration and many discussions, we have come to the conclusion that a separation would be best for both of us. Now the question arises whether it is possible to file for divorce online.

Currently, my wife and I are living separately and have already settled all financial and personal matters. We both agree that we would like to handle the divorce as quickly and as uncomplicated as possible in order to be able to put a final end to our marriage.

My concerns mainly lie in the fact that a traditional divorce proceeding in court can be very time-consuming and costly. Since we are in agreement on most issues and do not want to engage in a bitter dispute, it would be ideal for us to file for divorce online in order to save time and money.

Therefore, my question to you is: Is it possible to file for divorce online and thus expedite the process? What are the requirements that need to be met and what steps do we need to take for this? Are there any potential disadvantages that we need to consider?

Thank you in advance for your help and guidance during this difficult phase of my life.

Sincerely,
Dennis Koch

Dear Mr. Koch,

Thank you for your inquiry regarding the possibility of filing for divorce online. It is understandable that you and your wife would like to handle this process as quickly and easily as possible in order to put an end to your marriage. In fact, there is now the option to file for divorce online to save time and money.

The requirements for divorce in Germany are regulated in the Civil Code (BGB). In general, the marriage must have failed, meaning that the marital cohabitation must be so disrupted that restoration is no longer expected. Additionally, the spouses must have been living separately for at least one year.

To file for divorce online, you can contact specialized online platforms or lawyers who offer online divorces. You will usually need to submit some documents, such as the marriage certificate, birth certificates of the children (if applicable), and possibly a consent statement from your wife for the divorce. Additionally, you and your wife must enter into a so-called divorce settlement agreement, in which all financial and personal matters are regulated.

The advantages of an online divorce lie mainly in time and cost savings. The process can usually be completed faster than a traditional divorce proceeding in court. Additionally, the requirement to appear in court is often waived, as many appointments can be conducted online or in writing.

However, there are also some disadvantages to consider. In cases of complicated financial or personal matters that are not yet fully resolved, an online divorce may be more difficult. It is also important to inform yourself well and, if necessary, seek legal advice to ensure that all legal aspects are taken into account.

I recommend that you contact a specialized family law attorney to discuss your individual situation and find the best way to file for divorce together.

I hope that I could help you with this information. If you have any further questions, please do not hesitate to contact me.

Best regards,
Johann König
