Ask a lawyer on the topic of Divorce law

How can I prepare for custody of the children?

Dear Lawyer,

My name is Dennis Lehmann and I am currently in a difficult situation. My wife and I have decided to get a divorce, and I am very concerned about the custody of our two children. So far, we have shared custody, but I fear that my wife may try to obtain sole custody.

I am a loving father and I want to maintain a good relationship with my children. Therefore, I am wondering how I can best prepare for any potential legal disputes in order to secure my chances of obtaining shared custody.

I would like to know what steps I should take to strengthen my position and what documents or evidence I should gather to support my role as a father. Additionally, I would like to understand what rights and responsibilities I have as a father and how I can best prepare for discussions with my wife and possible negotiations.

I am willing to do everything in my power to protect the well-being of my children and ensure good co-parenting even after the divorce. Therefore, I am seeking your professional advice and support to help me prepare optimally for custody of the children.

Thank you in advance for your help.

Sincerely,
Dennis Lehmann

Dear Mr. Lehmann,

I can understand that you are worried about the custody of your children and that you want to do everything possible to maintain a good relationship with them even after the divorce. It is important to inform yourself early about your rights and responsibilities as a father and to prepare for any potential legal disputes.

First and foremost, it is important to know that in Germany, joint custody is generally seen as the ideal. This means that both parents generally have the same rights and responsibilities regarding the children. Sole custody is only ordered when it is in the best interest of the child, for example if one parent is unable to take responsibility for the child.

To strengthen your position and maintain your chances of joint custody, I recommend that you contact an experienced family law attorney early on. An attorney can advise you comprehensively, explain your rights, and help you take the right steps. Additionally, an attorney can help you prepare for discussions with your wife and possible negotiations.

In terms of possible evidence or documents that you can gather to support your role as a father, I recommend collecting all relevant documents and information that demonstrate your ability and willingness to care for your children. This may include doctor's visits, school reports, photos, diaries, etc. It may also be helpful to identify witnesses who can confirm your role as a father.

It is important that you prepare well and seek professional support to protect the well-being of your children and ensure good parenting even after the divorce. Do not hesitate to reach out to me again with any further questions or concerns.

Sincerely,
Johann König, Attorney at Law
