rebooking

I have booked the following flight with Air Berlin:

18.12.2011 Cologne - Gran Canaria 15:00 - 18:30

Today I received an email from Air Berlin with the following rebooking:

17.12.2011 Cologne - Gran Canaria 05:05 - 08:45

The reason given is: For reasons that were previously unforeseeable, it was unfortunately necessary to partially change the flight.

They offer compensation of €25.00.

My question: do I have to accept this? My booked vacation rental will only be available on the 18th and I deliberately chose the afternoon flight. I would like to cancel both the outbound and return flights, of course without any cost to me. Currently, it is being reported in the media that Air Berlin is cancelling 1,000 flights for rationalization reasons and the potential loss of jobs is also being discussed.

Do I, as a customer of Air Berlin, have to suffer as a result?

Dear questioner,

I will answer the questions you have asked taking into consideration the circumstances described and your input as follows:

Since the contracting party is unable to fulfill their part of the contract, you can also withdraw from the contract.

You do not have to settle for a compensation of 25 euros.

You should consider which option is better:

Either you take the flight and demand that you be provided with accommodation from the 17th to the 18th of December.

Or you completely withdraw from the contract and book elsewhere.

I must point out that this platform cannot replace detailed and personal legal advice. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided to a lawyer. The legal advice I provide is based solely on the facts you have provided. Adding or omitting relevant information in your description of the situation may result in a completely different legal assessment.

I hope I have given you an initial overview and that my explanations are helpful to you. You are welcome to contact me through the follow-up option on this platform.

Furthermore, I am available for legal representation. Any initial consultation fee paid would be credited in full.

A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, legal representation is also possible.
