Eviction
Dear Mr. Lawyer,
I have the forced eviction of my apartment tomorrow. I have been aware of the eviction for several weeks. My income comes from abroad. I have received the commission settlement from my boss, as well as the transfer slip signed by the bank with the bank stamp and the deduction receipt from my boss. However, the executing bank made a mistake and issued the clean papers only, but in Europe a double declaration is required. This caused the transfer to stall, the papers have now been submitted and the money should arrive on Friday with luck, but it did not happen, so I expect the money to arrive in the coming week.
My landlord, to whom I owe rent, told me that if he has the money or I present a new rental agreement, he would cancel the eviction. I also have a new rental agreement starting from September 1, 2010, I have agreed with the new landlord that I will gradually move in September. The deposit for the new apartment has not been paid yet and should be done with the money from the transfer.
Now, after submitting the rental agreement and the transfer receipts to my account, my landlord's lawyer said that it is not a valid rental agreement and the landlord could withdraw from it due to no payment being made yet. He also does not seem to be interested in the money coming into my account.
Mr. Lawyer, I have no way to store my belongings, so everything would have to be stored. This means that I cannot work either, so I risk that my clients could accuse me of fraud. My wife and I would end up in a homeless shelter, my 2 Afghan hounds would probably end up in the animal shelter.
I did not request any postponement against the eviction. Because I assumed I could settle everything before and pay my current landlord and hand over the apartment in a clean condition.
Tomorrow at 8:00 the bailiff will be at the door with a moving company. Please, Mr. Lawyer, I can't take it anymore, I had a brain tumor operation years ago, everything was fine again, but I can't handle this stress mentally. Can the bailiff do something positive for me?
I will voluntarily move out this week and hand over the apartment properly to the landlord by September 15, 2010 at the latest. Please, Mr. Lawyer, respond to me as soon as possible.
