I have the following question.
I am 100% severely disabled.
I receive unemployment benefits and benefits to secure my livelihood for rent and heating from the job center.
Now I am receiving a tax refund of 1200 euros. I am now obligated to present my tax assessment to the job center. Now the question arises whether the job center will suspend or reduce its benefits or demand a portion of my taxes? If so, how much can the job center demand?
In my opinion, this would not be fair, as I received the tax refund mainly because of my disability. In addition, I still owe my girlfriend 800 euros. And my overdraft is also maxed out at 1450 euros.

Thank you for your inquiry. I would like to answer it as follows:
Unlike ALG II, when receiving ALG I, you are generally allowed to receive tax refunds without them being taken into account.
However, when it comes to social security benefits, things are different. In this case, tax refunds are usually considered as income under the SGB II and are therefore taken into account.
The exact amount that will be taken into account depends on the composition of your income and cannot be definitively determined in a remote initial consultation.
Unfortunately, your private debts will not affect the calculation. Based on experience, I can tell you that you should accept the tax refund, as it is unlikely that it will all be deducted.
