pension law
April 25, 2011 | 40,00 EUR | answered by Dr. Dr. Danjel-Philippe Newerla
As a late bloomer in Germany since 1987, I applied for a disability pension (Erwerbsminderungsrente) in August 2005, which was rejected in Germany. I have been receiving disability pension from Poland since 2005, according to regulations EWG No. 1408/71 and EWG No. 574/72.
My question is: Can I be treated differently because I can only receive pensions from Poland?
Dear inquirer,
Thank you for your inquiry.
If the circumstances were the same at the time of the application, there should normally not be a different outcome.
It is also possible that the authority in Germany did not properly understand the circumstances back then.
You should have filed an objection at the time. Unfortunately, this is no longer possible today.
I wish you a pleasant Easter Monday!
Kind regards,
