Application for unemployment benefits after a break
October 9, 2009 | 30,00 EUR | answered by Andreas Scholz
Dear Sir or Madam,
Recently, I was given a redundancy notice by my employer. Due to my long service with the company, I will not be leaving until 30.06.2010. For personal reasons, I would like to take a break immediately afterwards, during which I will not be working. I cannot say exactly how long this break will be. This means that I will not be working from 01.07.10 and will not be looking for work during this time. After this break, I will definitely be looking for work again and would like to claim my unemployment benefits based on the time before 30.06.10. What options do I have to not lose my unemployment benefits, what deadlines should I be aware of, and what steps do I need to take?
Thank you in advance for your information.
Dear inquirer,
First of all, you must register as unemployed at an early stage, in accordance with § 38 SGB, so that no later than the third day after becoming aware of the termination date of your employment relationship. If you register late, a waiting period of one week may be imposed in accordance with § 144 para. 1 no. 7 SGB, § 144 para. 6 SGB.
In addition, you must observe the qualifying period according to § 124 SGB III. Your entitlement to unemployment benefits will lapse if you have not worked for at least 12 months in an insured employment relationship within the two years prior to the application. Therefore, the break you intend to take should not be too long, and certainly should not exceed one year after the end of the employment relationship.
I hope this information has been helpful to you, feel free to ask if you have any questions.
Sincerely,
Andreas Scholz, Attorney
