Ask a lawyer on the topic of Internet and computer law

Am I as a blogger obligated to comply with certain imprint requirements?

Dear Internet and Computer Law Attorney,

I run a blog where I regularly write about various topics. Lately, I have heard more and more about bloggers needing to comply with certain imprint obligations. I am unsure if this applies to me and what specific information I need to include in my imprint.

Currently, I only have my name and email address listed on my website. I am concerned that I may be violating legal requirements and could face legal consequences.

Could you please explain to me what imprint obligations apply to bloggers and what information must be included in my imprint? Are there differences depending on whether my blog is purely private or if I also generate income from it?

I would like to ensure that my blog is legally compliant and that I do not encounter any issues. What steps can I take to review my website in terms of the imprint and make any necessary adjustments?

Thank you in advance for your help and advice.

Sincerely,

Renate Endres

Dear Mrs. Endres,

Thank you for your inquiry regarding the legal requirements for bloggers. It is indeed important for you as the operator of a blog to comply with certain legal regulations to avoid legal consequences.

In Germany, the imprint obligation according to § 5 TMG (Telemedia Act) applies, which also applies to blogs. As the operator of a blog, you are required to provide certain information in your imprint to ensure that your website complies with legal requirements. Mandatory information includes your full name, address, an email address for contact, and possibly a phone number. If you operate a business, additional information such as legal form, registration court, and commercial register number must be provided.

It is important to note that this imprint obligation applies regardless of whether your blog is purely private or if you also generate income from it. Even private bloggers must have an imprint if their blog is publicly accessible.

To ensure that your blog is legally compliant, I recommend reviewing and, if necessary, adjusting your imprint. You can do this independently by adding the required information to your imprint. Alternatively, you can also hire a lawyer or specialized agency to review your imprint to ensure that all legal requirements are met.

I hope that this information has been helpful to you and I am available for further questions.

Best regards,
