As you may have heard, Quelle has filed for bankruptcy and had to sell all of its merchandise. So, of course, I ordered something at the cheap prices, but never received it. I have already written to Quelle about this. However, they want the money + a late payment fee of 5 euros. Do I have to pay this even though I never received the merchandise?? No one is responding from Quelle either. If I were to hire a lawyer now, I would have to pay even more. Is there a cheaper way to receive the merchandise or not have to pay??
Thank you very much
Regards Brigitte
Dear questioner,
I will answer the questions you have asked, taking into consideration the circumstances described and your input, as follows:
You do not have to pay the invoice for the ordered goods if you have not received the goods.
In particular, no reminder fees are to be paid.
You should contact Quelle by registered mail, request delivery of the goods, and inform them that the purchase price will only be paid upon receipt of the goods.
If Quelle sends another reminder or applies for a payment order, simply object to it.
Unfortunately, at this time all you can do is wait. Quelle is completely overwhelmed with the insolvency and cannot keep up with deliveries.
Finally, I must point out that this platform cannot replace a detailed and personal legal consultation. The sole purpose is to provide an initial rough assessment of your legal issue based on the information you have provided to a lawyer. The legal advice I provide is based solely on the facts you have provided. Adding or omitting relevant information in your description of the facts may lead to a completely different legal assessment.
I hope I have given you a first overview and that my explanations have been helpful. You are welcome to contact me through the inquiry option on this platform.
Furthermore, I am available for legal representation. I would credit the initial consultation fee in full.
A greater distance between lawyer and client is generally not a problem. With the help of modern communication tools such as email, mail, fax, and telephone, legal representation is also possible.
Sincerely,
Steffan Schwerin
