Right of residence
Hello,
I am a Belarusian and have been living in Germany with my 19-year-old daughter since December 30, 2003. During this time, I have been married three times, but each marriage did not last more than 2 years.
With each marriage, we both received a residence permit for 3 years. However, not everything went smoothly. Between the first divorce and the second marriage, we were dependent on a tolerated stay.
According to my calculations, we have had a residence permit for a total of 5 years now, which means we have the right to a settlement permit.
However, the last marriage (from February 25, 2009) looked more like a weekend relationship. As I am employed and my daughter is finishing her high school diploma, I was forced to keep the apartment we rented before this marriage due to the distance and my challenging work conditions. I do not know if the immigration office is aware of this. In any case, we were never questioned about it.
I will soon report my ex-husband for theft, which is why the marriage failed on September 20, 2010. He will of course claim to the immigration office that we did not live together.
Could it be that the 1.5 years of our marriage will not be accepted by the immigration office and therefore I do not have the right to a settlement permit?
If they are not accepted, do we have the right to obtain a residence permit regardless of marriage?
Since we have been living in Germany for 7 years, I have been employed full-time for 3.5 years, am not dependent on the state, and my daughter is successfully completing her high school diploma, could we be deported?
