Do I have to bear the legal costs for an out-of-court mediation myself?

Dear Sir or Madam,
I have a question regarding the legal costs for an out-of-court mediation and hope that you can assist me. In my case, I was involved in a dispute with my landlord and opted for an out-of-court mediation. My lawyer conducted the mediation and now I am wondering if I have to bear the legal costs for it.
For background information: I had issues with my landlord regarding a rent reduction due to defects in my apartment. Since I wanted to avoid a court dispute, I chose mediation. My lawyer accompanied and supported me throughout the entire process.
My concern now is whether I have to cover the legal costs for the mediation myself and whether they can be covered by my landlord or an insurance company. I would like to know if there is a possibility to reduce the costs or if I have to bear them entirely on my own.
Can you please assist me and let me know if I have to bear the legal costs for the out-of-court mediation myself? Are there ways to reduce the costs or is there possibly an insurance company that will cover them?
Thank you in advance for your help.
Best regards,
Konrad Waldmüller
Dear Mr. Waldmüller,
Thank you for your inquiry regarding the legal costs for extrajudicial mediation. I understand that you are concerned about the cost coverage and would like to assist you further.
In general, the legal costs for extrajudicial mediation are to be borne by the client. This means that as the client, you are responsible for paying the costs for legal advice and support during the mediation. In your case, involving a dispute with your landlord, you are usually obligated to cover the legal costs.
However, there are ways to reduce the costs or even have them covered by insurance. Firstly, you can enter into a fee agreement with your lawyer to determine the costs in advance or bill on an hourly basis. This way, you have more control over the costs and may potentially save money.
Additionally, you can opt for legal expenses insurance that covers the legal costs for mediations and other legal matters. It is advisable to inquire about the services and conditions of the insurance in advance to ensure that your mediation costs are covered.
It is important that you are clear with your lawyer about the costs and potential financing options before undergoing extrajudicial mediation. This way, you can ensure that you keep an eye on the financial aspects and avoid any unexpected costs.
I hope that this information has been helpful to you. If you have any further questions or require more detailed advice, please feel free to contact me.
Best regards,
Ralf Hausdorf
