Ask a lawyer on the topic of Copyright law

Can I include famous quotes in my blog?

Dear Copyright Lawyer,

I operate a blog where I regularly write about various topics. In my posts, I would like to incorporate famous quotes from other authors or personalities to emphasize or clarify my thoughts. However, I am unsure if this is legally permissible or if I would be infringing on copyrights by doing so.

Currently, I am unsure if I can simply use the quotes without obtaining the author's permission. I want to avoid getting into legal trouble or being issued a cease and desist letter. At the same time, I want to be creative and versatile in my blog posts and use quotes as inspiring elements.

So, how should I proceed to legally incorporate famous quotes into my blog? Are there specific rules or procedures I need to follow to avoid copyright infringement? Are there any exceptions or special regulations that would allow me to use quotes without permission?

I thank you in advance for your assistance and guidance on this matter, and I look forward to your assessment and possible solutions.

Sincerely,
Alexander Schlattmann

Dear Mr. Schlattmann,

Thank you for your question regarding the use of quotes in your blog and the legal aspects related to copyright. It is important to be aware that quotes are generally protected by copyright, as they are considered intellectual property of the author. This means that you cannot simply use quotes from other authors or personalities without obtaining their permission.

However, there are exceptions and regulations that allow you to legally incorporate quotes into your blog. One of the most important regulations is the right to quote, which is anchored in § 51 of the German Copyright Act. According to this regulation, it is allowed to use quotes in one's own work as evidence for one's own thoughts, as a basis for discussion, or for illustration.

To use quotes correctly from a legal standpoint, there are some things you should consider. Firstly, quotes should be used appropriately and in a context that clearly demonstrates the purpose of the quote. This means that you should not simply insert the quote without reference to your own text. Additionally, you should correctly indicate the source of the quote, by mentioning the author and possibly the work from which the quote originates.

It is also important to note that not all quotes automatically fall under the right to quote. Especially with very short or widely-known quotes, it can be difficult to apply the right to quote. In such cases, it may be advisable to obtain the author's permission to ensure that you are not infringing on copyright.

In summary, you should ensure that you use quotes appropriately, indicate sources correctly, and if in doubt, obtain the author's permission. This way, you can ensure that you are legally on the safe side while also working creatively and diversely in your blog posts.

I hope this information helps you and I am available for further questions.

Sincerely,
Sandra Altmann
