Business registration

Dear Sir or Madam,
all preparations for the part-time business start-up have been completed, now it is about the text that will be included in our business registration as the field of activity. "We trade in non-permit chemical-technical products (cleaning agents, polishes, etc.) for the automotive, private and commercial sectors, as well as automotive accessories and workshop equipment (mostly through online shop and dealers, no retail store). The chemical-technical products are produced for us to a large extent and then sold under our own label." On this label, we will (according to the law) be recognized as the manufacturer for some products (Private Label). Do we therefore need to mention the production of the products as an activity in the business registration, or is trading sufficient (otherwise we would need a facility in accordance with the Production Facilities Ordinance)? We would greatly appreciate the creation of a legally compliant "two-liner" for submitting the business registration. The text in quotation marks could be the guideline here.

Dear inquirer,

Thank you first of all for your inquiry!

Taking into account your information, I am happy to answer the question you asked summarily as follows:

Ultimately, the top priority when registering a business is that the information provided is both accurate and complete.

Based on your description, you can be classified as a manufacturer at least in terms of product liability, so this characteristic should also be included.

Therefore, the business registration could include something like this:

Trading and manufacturing of non-permitted chemical-technical products (cleaning agents, polishes, etc.) for automotive, private, and commercial needs, as well as automotive accessories and workshop equipment.

Based on your description, you not only act as a distributor, but also as a producer of the relevant goods. Therefore, this should also be reflected in the business registration.

I hope that my explanation has helped you. You are welcome to contact me within the scope of the follow-up option on this platform or via my email address.

I would like to point out the following to you: The legal advice I have provided is based solely on the information you have provided. My response is only an initial legal assessment of the situation and cannot replace a comprehensive examination of the facts. Adding or omitting relevant information can lead to a completely different legal assessment.

I wish you a pleasant Tuesday evening!

Sincerely,
